Third accused, A. A. Punchi Banda, affd.
I am third accused in this case. I am Inquirer into Sudden Deaths, Pallis Pattu. I remember the night of the riot at Teldeniya-on the 30th May. I did not take part in the riot. On that night I was in the Ratemahatmaya's walauwe I went to his walauwe at about 6.0 o'clock, and returned to my house at 9.0 o'clock. Fourth accused, James Appu, affd.
I am the fourth accused in this case. I am a boutique keeper in Teldeniya. There were riots there on the 30th May last. I was in my boutique. It is not true that there was a meeting in my boutique at 12.0 noon. I carried on my trade. I bear a good character. I have never been involved in a criminal case. There was a considerable number of people on the street right through the day. Two Moorish girls and a woman called Ran Manika came and stayed that night in my house. Those two girls are Asia Bebe and Jatur Bebe. They are the sisters of the com- plainant in this case, Bachcha. Ran Menika brought them. They stayed that
night in my house and left in the morning.

I am a police constable, stationed at Teldeniya. On the 30th May I was there. There were disturbances that day. I was doing duty. I know the boutique street I was on beat on the road running between the two lines of the road. I was on beat from 12.0 noon to 6.0 p.m. I saw James's boutique. It was opened. He was carry- ing on his trade as usual. I did not see any of these accused there. I did not hear any speech made. There were crowds all along the road. Near James's boutique the people were buying things.
Ran Menika, of Teldeniya, affd.
I know Ana Mohideen Bachcha. I was employed as a servant of his on the 30th of May last. He has got two little sisters. I was in charge of them. On the 30th May, when there were riots. I took the two children, Asia Bebe and Jatur Bebe. to the fourth accused's house.
Seventh accused, D. B. Tennekoon, sworn.
I am a Christian. I am married, and I have about seven children, who are all Christians. Some of my children are boarded in the Church Missionary Society School in Kegalla. I have absolutely nothing in common with the Buddhists. On the 30th I went to James Appu's boutique and bought goods. I was in the habit of going to his boutique almost every Sunday. After buying my things at his boutique I reached home at about 9.0 o'clock. We have service at 4.30 p.m. at Teldeniya. I attended service that Sunday with my children. After service I got home at about 5.30 p.m. The boutiques are about half a mile from my house. When I was in the house I heard a noise at about 7.30 p.m. Then I went to Catechist's house, which is close by, and was talking to him about this noise. I returned at about 8.0 o'clock.

I am in charge of the Church Missionary Society's Church Mission Society, Kandy. I took charge from Mr. Short. I know the seventh accused is a Christian. After these riots I had been very busy in doing special constable work. I know that in Teldeniya a large number of Moorish people have been befriended by the Christians. It is very unlikely that this accused would take part in these rioté.
D. B. Perera, sworn.
I am a Christian. I have been in Teldeniya for six months. I have been a Catechist for the last thirty-eight years in the Church Missionary Society. I know the seventh accused. My house is close to his. On the 30th he attended service at 4.30 p.m. I was preaching that day. After service he went to his house. About 7.0 or 7.30 he came to my house. We heard a big noise, and we were speaking there when the accused came from his house. He left my house at about 8.0 o'clock.
(At this stage the seventh accused was acquitted.)
Eighth accused, Ķalu Banda, affd.
On the 30th I went to the fourth accused's boutique at about 5.0 o'clock p.m. I bought something from his boutique, and afterwards went home. I did not take part ip riots. I was not present when the alleged seditious remarks were made by
the third accused.
S. M. W. Tillekeratne, affd.
I am a Notary Public. I practise in Udis Pattu. I know the eighth accused. On the 30th I and he came together to Teldeniya. We got there at about 3.30. He stopped at James Appu's boutique. He told me he came to buy things. I did not see him afterwards.
Puncha, of Rambukwelle, affd.
I live in Rambukwelle, about a mile from Teldeniya. On the 30th I saw the eighth accused in his house from 7.0 or 8.0.
Finding of the Court :—
First accused, not guilty.
Second accused, guilty of the third and fourth charges. Third accused, guilty of all charges except second. Fourth accused, guilty of third and fourth charges. ~ Fifth accused, guilty of third and fourth charges. Sixth accused, guilty of third and fourth charges. Eighth accused guilty of third and fourth charges.
In this case the witness Bachcha was sentenced to undergo twenty-one days' rigorous imprisonment for giving false evidence.
