WITH reference to your letters of the 31st ultimo,* with regard to the intern- ment of the officers and men of the " Burni," I,am directed by Mr. Secretary Lyttelton to transmit to you, to be laid before the Marquess of Lansdowne, copies of a letter from the Treasury and of the telegramt which the Secretary of State has addressed to the Governor of Hong Kong on the subject.
Mr. Lyttelton presumes that Lord Lansdowne will endeavour to arrange for the payment by the Russian Government of the cost of the internment in the manner suggested by the Lords of the Treasury, and I am to ask that this Depart- ment may be informed of the result in order that instructions as to the method of accounting for the expenditure may be sent to Hong Kong.

Foreign Office, September 6, 1904. I AM directed by the Marquess of Lansdowne to acknowledge the receipt of your letter, with enclosures, marked 30588/1904, of the 2nd instant, relating to the internment of the officers and men of the Russian destroyer " Burni.”
With regard to the method of repayment by the Russian Government of the expenses which may be incurred by the Government of Hong Kong, I am to request that you will call the attention of the Secretary of State for the Colonies to Article 58 of Section IV. of the International Convention signed at the Hague on July 29th, 1899, dealing with the internment of belligerents, which states that " at the conclu- sion of peace, the expenses caused by the internment shall be made good."
It is true that the Convention referred to refers only to warfare on land, but
it seems probable that by analogy a similar procedure would be held to be applicable to the case now in question.
However this may be, Lord Lansdowne is of opinion that it would be desirable in any case to postpone a representation to the Russian Government on the subject, as His Lordship has reason to know that the Russian Ambassador is at present in communication with his Government with regard to the Japanese objections to the repatriation of the men to Russia.
