ARTICLE II.

Each Government shall advertise in the local newspapers the letting of their Opium and Spirit Farma jointly, to be applied for by tenders jointly; such tenders to be in duplicate, and addressed one to the officer of each Govern- ment to be named for that purpose in the adver- tisement; but both copies to be delivered at the office of the Colonial Secretary at Singapore by a date to be appointed in such advertisement not later than the month of September preceding the date for the commencement of the lease of the Farms.

The advertisement shall, if not altered by mutual consent, be in the form at present used by the Straits Government.

ARTICLE III.

The acceptance of any tender, and all condi- tions relating to the Farms, as well as the securities for the due performance and observance

on the part of the farmers of the contract of lease of the joint Farms, shall be settled between the two Governments for their mutual protection and benefit; but all monies payable by the farmers to the said Governments under such contract shall be paid by such farmers into the Treasury of the Straits Government.

ARTICLE IV.

The joint rental of the two Farms shall be divided between the two Governments in propor- tion to the number of the male adult Chinese population of the country for the time being under each Government.

ARTICLE V.

The population of each country shall be ascertained for the purposes of the last preceding article at such times and in such manner as may be agreed upon between the two Governments, provided that the joint rental of the two Farms for the first triennial period commencing on the 1st January, 1886, shall be divided between the two Governments in such proportions as may be estimated to be equitable by a Joint Commission appointed by the two Governments.

ARTICLE VI

Either Government may terminate this Con- vention by giving notice in writing to the other Government eighteen months before the expira- tion of any joint lease of the two Farms.

MEMORANDUM of an agreement between

Her Majesty's Government of the Straits Settlements with the Government of the Independent State of Johore respecting the conditions under which the Opium FarmS of Singapore and Johore may be let jointly instead of separately as heretofore.

Whereas it is desirable in the interests of the Straits Settlements and of the Independent State of Johore to prevent smuggling, and to enter into a mutual understanding that the Opium Farms of Singapore and Johore should, under the present system of letting, be vested, from time to time, in the same farmers under one joint contract with both Governments, and that the joint rental for both Farms should be apportioned between the two Governments under a satisfactory and equitable arrangement.

It is hereby agreed by the Contracting the Struite Parties, hereinafter described Government and the Johore Government, in the manner following:-

ARTICLE L

The Straits Government and th Johore Government will do their utmost to prevent smuggling of any kind along the coasts of their respective territories; and in order to facilitate the apprehension of persons infringing fiscal regu- lations, it shall be lawful for any vessel, Guard, Police, or Revenue boat, belonging to either Government, to follow and examine any boat or vessel reasonably suspected of smuggling, not- withstanding that such boat or vessel may have passed at the time of search beyond the line of water delimitation of such State as defined by International Law, to wit:-In waters less than six miles in width by an imaginary line midway between the shores of the respective territories; and in open waters by a line drawn at a distance of three miles from the low water mark of each shore.
