HENRY BARKLY.-Enacted by the Governor of Mauritius and its Dependencies, with the advice and consent of the Council of Government thereof.

An Ordinance to consolidate and amend certain of the Laws relating to Indian Immigrants

and other Labourers within this Colony and its Dependencies, and to make better Provision for the Protection of Claims for Wages, and for other Purposes.

[November 29, 1867.] WHEREAS it is expedient to consolidate and amend certain of the Laws relating to Indian immigrants and other labourers within this Colony and its Dependencies; and to make better provision for the protection of claims for wages, and for other purposes;-

Be it therefore enacted by his Excellency the Governor, with the advice and consent of the Council of Government, as follows:-

"New Immi- grant.'

1. The term "New Immigrant" extends and applies to all male Indian labourers Definition of the who have immigrated into this Colony or its Dependencies since the publication of Terms- Her Majesty's Örder in Council of the 15th January, 1842, or who may hereafter immigrate as above from British India, and for whose introduction passage-money has been or may hereafter be paid by the Government or by any individual employer, and who have not completed an industrial residence of five years, as hereinafter defined.

The term "Old Immigrant" extends and applies to all male Indian labourers who have immigrated as above previous to the promulgation of the said Order in Council, or for whose introduction no such passage-money has been paid, or who shall at any time, now or hereafter, have completed their said industrial residence.

The term "Industrial Residence" means a residence of five years in this Colony, or its Dependencies, under written contract of service for hire and performance of such contract.

The "Industrial Residence" shall be deemed to have been completed:

1st. By service under such contract, one or more, for the term of five years, testified by a discharge therefrom under the hand of a Stipendary Magistrate.

2nd. By redemption, as hereinafter provided.

3rd. By release, as hereinafter provided.

4th. By cxemption by the Governor, as hereinafter provided.

For the purposes of the present Ordinance, the term "Requisitionist” extends and applies to any person who shall have made requisition for the introduction of Immigrants to be specially engaged to him in India, or to be allotted to him on arrival in Mauritius, as the case may be.

For the purposes of the term " Substituted Employer" extends and applies : 1st. To any person other than the requisitionist to whom any new immigrant shall, on arrival in Mauritius, be engaged under contract of service for the whole period of his industrial residence.

2nd. To any person to whom any Contract of Service with a new Immigrant shall have been transferred for the unexpired residue of the industrial residence of such immigrant, either by consent of parties, or under the provisions of Article 7 of Ordi-

nance 16 of 1802.
