rights at this stage, while the position so far as the Communists are concerned is still relatively fluid. On the other hand, we are perturbed to learn from paragraph 1 of the Governor's Savingram mentioned. above that, although the Interpretation Ordinance, 1950, has now been amended in the sense suggested by Tomlinson in his letter 2 (F 18553/10147/10) of the 4th February, it has not yet come into force, and therefore that the definition of the colony as given in Section 39 B (1) of the 1911 Interpretation Ordinance still holds good. In other words, the Colony is defined as the whole area of land and water lying within
the line defined on the map (i.e. the "old square boundary")
4. As indicated in Tomlinson's letter although our view of the extent of territorial waters as now shown on the map by the Admiralty Hydrographer may represent a correct interpretation of the 1898 Convention (and in this we incline to agree with the Governor that in strict law the first sentence of paragraph 4 of his Savingram is correct), it will be difficult to maintain, so long as the 1911 Ordinance remains unamended.
