The position will then be that the organisation in Malaya of branches of a foreign political party to which registration has been refused will be illegal but that individual membership will not (repeat not) be an offence.. See in this connexion Section 10 of the Singapore Ordinance, as amended pursuant to the Lampson-Wang agreement.

4. We assume that prior to the fall of Nanking you received a copy of Hong Kong despatch No. 14 to the Colonial Office, enclosing the draft of a proposed Hong Kong Societies Ordinance. We should be grateful for your urgent views on desirability of taking action against foreign political parties in Hong Kong and on the bill as drafted.

5. The draft is being considered in London from the legal point of view. Our preliminary view is that if it is enacted the insertion of a clause similar to that of Section 10 of the Singapore Ordinance would be essential.
