free to choose and which the defendant has no opportunity
of calling in question.
I am of the opinion that the
amendment of the Ordinance by the addition of the Proviso
suggested in the note of my Legal Adviser's comments
sent to you under cover of my Savingram No. 96 of the
6th May is desirable and that the matter is of sufficient
importance to call for the early introduction of an
amending Ordinance provided that you do not consider it
likely to give rise to any undesirable political reaction.
