I have the honour to submit for the signification
of His Majesty's pleasure the following Ordinance intituled:
"An Ordinance further to amend the Telecommunication
Ordinance, 1936".
2. An explanatory report by the Attorney General showing the reasons and the occasion for passing the Ordinance is also enclosed, together with a statement that in his opinion assent may properly be given. Two copies of the Gazette Supplement containing the Ordinance are also enclosed.
3. In this connection I refer to your Top Secret savingram No. 73 of 24th March, 1949, and previous correspondence concerning the proposal to amend the Telephone Ordinance, 1925, or the Telecommunication Ordinance, 1936, so as to provide power to order the inspection of the Telephone Company's records and the interception of telephone messages. The Ordinance under report amends Ordinance No. 18 of 1936 so as to apply to the Telephone Company the provision of Section 2 (Interpretation) and Section 4 of the Ordinance. The latter section gives certain powers to the Governor in the event of an emergency or in the interest of the public safety, including the powers at present required. It is at present the position that action under section 4 (1) is necessary in the interests of the public safety.
