Dear Paskin,

In view of the arguments in the Governor of

(293) Hong Kong's telegram 956 of the 20th October, we

have considered whether we should advise that an opportunity should be sought to test our position in the Walled City of Kowloon before a court or in arbitration proceedings.

We have always held the view that the re-introduction of Chinese jurisdiction in the Walled City would seriously prejudice military requirements in Hong Kong. At the same time, having regard to the Law Officer's opinion and the obvious undesirability of submitting the whole of our defence case to cross-examination in a court or arbitration proceedings, we feel that it would not be wise, from the defence point of view, to attempt to resolve the present difficulty by recourse either to the International Court or to arbitration.
