Now, in connection with this section 175, I would like

to touch upon one question, which I overlooked before.

Under the ordinance of 1899, practically the same law

existed in ragard to open spaces as in the Ordinance of

1903. I think it is 30, - word for word almost, - but

thers was this very important difference that it was

qualified by other clauses which modified its effect in

regard to buildings subsequently erected to that date.

That is, to 1399.

analgamated in 1903, all these qualifications or

modifications were deleted, but the original clause

regarding open spaces was left in in its entirety. The

result of that has been that houses erected between

1899 and the passing of the Health Aot in 1903 are not

allowed any of those modifications, which it was

intended they should have had under the 1899

Ordinance, and that is just the same as if they were

insanitary houses erected prior to 1899.
