I have the honour to transmit a petition dated the 17th September, 1946, which has been addressed to you by Mr. Shum Wai Yau,

a journalist of this Colony, together with an appended petition signed by the Right Reverend R.O. Hall, Bishop of Hong Kong and five other

gentlemen. I enclose also a copy of a letter dated 23rd September,

1946, from Mr. M.A. da Silva, Solicitor, under cover of which the two

petitions were forwarded to me.

On August 28th I received a formal application from

General Chang Fa-Kuei, General Officer Commanding, Generalissimo's

Headquarters, Canton, for the surrender of Mr. Shum Wai Yau in accordance with the terms of the Chinese Collaborators (Surrender) Ordinance, 1946,

a copy of which is enclosed for convenience of reference. I also enclose

for your information a copy of General Chang Fa-Kuei's letter dated 20th

August, 1946, in which are set out the grounds on which the surrender of

Mr. Shum is requested. This letter was accompanied by a large number of

extracts from war-time issues of Mr. Shum's newspaper, the WAH KIU YAT PO,

which are regarded by the Chinese Authorities as evidence of his collabora-

tionist activities. The translation of some of these extracts has now

been completed and in view of their contents and the allegations made in

paragraphs (3) and (4) of General Chang Fa-Kuei's letter of 20th August

I and my legal advisers are of the opinion that a prima facie case has

been made out by the Chinese Authorities that there are reasonable grounds

for inquiry as to whether Mr. Shum should be surrendered. I consider that

his detention is desirable in order that he may not attempt to escape from

the Colony and that he may be easily available for the purpose of the

inquiry and I have accordingly signed a warrant for his arrest and deten-

tion in accordance with Section 4 (1) of the Ordinance. The next step
