I agree throughout with the line taken in this draft but feel that its language does not sufficiently recognise that (see the last sentence of No.16) the Governor has already undertaken not to reach any decision adverse to Shum until the Secretary of State has considered the petition. Also if, as I agree we should, we are to reply to the solicitors in the sense of your minute above, we should keep the Governor informed of the line we are taking.

I attach a revised draft. Have you any comments on it? Will you please return it to me through Mr. Mayle in case he has any comments?

After discussion with Mr. Dale I have suggested some further amendment in paragraph 2 to cover the possibility that in the last sentence of his telegram (No.16)which was I think in response to the request in the last sentence of our telegram (No.13 the Governor only intended to convey that he would not take a decision until the Secretary of State had received and considered the petition, and that he had not in mind the course we are now suggesting, namely, that if it becomes clear that the decision is going to be for surrender, the Secretary of State should have an opportunity to consider the petition before the decision is taken. I have had a fair copy made of the draft as amended.
