Read Sections 68 and 69 of Gaol Regulations. Proposed by the Honourable J. F. Mercer, Esquire, and seconded by R. Maitland, Esquire, and carried unanimously.
Resolved. That Section 68 of Gaol Regulations be so far amended as to divide Misdemeanants into two classes:
And that when confined these two classes should be kept separate.
Addendum. In Justice also desire to represent that the present place of confinement for Trial Criminals be altered to a place with the cells of the Criminal Prisoners, it being desirable to preserve the separation between Debtor and Criminal Prisoners.
Proposed by the Honourable J. F. Mercer, Esquire, and seconded by C. May, Esquire, that Rule 19 of the Gaol Regulation be amended as follows: —
Misdemeanants of the 1st Class shall not be compelled to do any work beyond the ordinary work necessary for the furnishing and cleaning of their Rooms & Cells; and such Misdemeanants, except those sentenced to hard labour, shall be put to such Work as they may be fitted for, but shall not, except for punishment, be put to Stone Breaking, Oakum Picking, or working on the Treadmill.
Every convicted Felon shall be put to such labor as the said Governor shall direct, unless it be expressly ordered in the Warrant of Commitment. And after the close of the month of December in each year, the said Governor shall make out an account of the profit and loss of Gaol labour for the preceding year, and such account shall be forwarded to the Colonial Secretary for the information of the said Council.
Regulation stands amended as above.
