I was first appointed Puisne Judge in the Supreme Court (See Letters Patent of Sir F. Rogers dated 17th and 19th April 1862) but it was subsequently and before my leaving England, intimated to me at the Colonial Office that the post intended to be created in the Colony was that of "Judge of the Court of Summary Jurisdiction." My Commission under the Seal of the Colony bears date 22nd day of September 1862.

The greater portion of the business of which the Court of Summary Jurisdiction has cognizance was previously within the Jurisdiction of the Supreme Court, and the Interpreter and Bailiff appear to have dated their appointments as of the time when they were originally appointed. As the Ordinance under which the Court of Summary Jurisdiction was established bears date 22nd March 1862 and came into operation on 7th July 1862, it is considered advisable to offer this explanation.
