(3) In this section "certificate of competency" means a certificate of competency as A.B.-
(2) granted in accordance with rules made under
section 6; or
(b) having, by virtue of an order under section SB.
the same effect as if so granted.
(4) Section 126 of the principal Act and section 58 of the Merchant Shipping Act 1906 stall cease to have offect in relation to any seaman for the time being engaged in a British ship registered in Hong Kong
58. Where provision is made by the law of any pan of the Commonwealth, other than Hong Kong, for the grant of certificates of competency as A.B., and the Commonwealth. Section 6 of the principal Ordinance is amended by adding, after subsection (2), the following-

1978.
(2A) Rules made under subsection (2) in respect of the grant of certificates of competency as A.B. shall direct that no such certificate shall be granted to any person wales-
(a) he has reached such minimum age as may be
prescribed; and
(6) he has performed such qualifying service at sea
as may be prescribed; and
(c) he has passed such examination 19 may be
prescribed:
Provided that such rules may authorize the grant of such a certificate to any person, notwithstanding that ho has not complied with the conditions aforesaid, if he shows, in such manner as may be prescribed, that he was serving as A.B., or in an equivalent or superior deck rating on the date on which the rules came into force, or has so served at any time before that date.”.
