(ii) in the case of injury not specified in the First Schedule, the loss of earning capacity permanently caused by such injury shall, so far as possible, be assessed in conformity with the scale of percentages specified in that Schedule.".
Section 1401) of the principal Ordinance is amended by deleting
"12" wherever it occurs and substituting the following—

黑 Section 17 of the principal Ordinance is amended by inserting immediately after subsection (2) the following—i
"(24) An agreement approved by the Commissioner under this section shall be read and construed as providing (whelber or not it so provides in fact) that, where the employer fails to pay any sum as compensation within 21 days after the date stipulated in the agreement for the payment thereof, the employer shall be liable to pay to the workman a surcharge of five per cent of such sum or $50, whichever is the greater, in addition to the compensation payable under the agreement.".
