Amendment

(1) By being renumbered as subsection (1) thereof,

(2) In subsection (1) by deleting ", and in default shall be liable to a fine of one thousand dollars for every death or deser- tion which he may neglect to report”.

(3) By inserting, after subsection (1), the following new subsection-

“(2) Any master of a ship who fails to comply with sub- tion (1) shall be guilty of an offence and shall be liable oo conviction to a fine of $5,000.";

In subsection (2) by deleting "liable to a fine of five hundred dollars" and substituting "guilty of an offence and shall be liable. on conviction to a fine of $10,000 and to imprisonment for 6 months".

(1) In subsection (5) by deleting "In default such owner, agent or master shall be liable to a fine of two thousand dollars.”.

(2) By inserting, after subsection (5), the following-

"(6) If subsection (5) is not complied with, the owner, agent and master concerned aball, unless he has a reasonable cxcuse, be guilty of an offence and shall be liable on com- viction to a fine of $5,000,

(7) For the purposes of subsection (6)

(a) compliance by the owner, agent or master shall be deemed to be compliance by all of them; and

(6) an owner, agent or master does not have a reason- able excuse by reason only that he bas delegated his responsibility to his agent".

In subsection (2) by deleting "such requirement shall be liable to a fine of one thousand dollars" and substituting “any such re quirement shall be guilty of an offence and shall be liable on conviction to a line of $5,000”.

(1) In subsection (1) by deleting "such information or assist- ance shall be liable to a fine of five hundred dollars” and sub- stituting "the required information or assistance shall be guilty of an offence and shall be liable on conviction to a Ane of $5,000".

(2) By deleting subsection (2) and substituting the following new subsections-

"(2) Every structural alteration made to a passenger ship shall be notified in writing to the Director not later than 24 hours after it has been made or as soon after the expiry of that period as is practicable.

(3) The owner and master, and the charterer and agent (if any), shall be severally responsible for ensuring compli- ance with subsection (2), but compliance by one of those persons shall be deemed to be compliance by all of them.

(4) Where subsection (2) has not been complied with, cach of the persons mentioned in subsection (3) shall, unless he has a reasonable excuse, be guilty of an offence and shall be liable on conviction to a fine of $10,000 and to imprison- ment for 6 months.",

In subsection (1) by deleting "liable to a fine of two thousand dollars, and to an additional Anc of five hundred dollars for every caccas passenger, or if the fare of any passenger on board exceeds five hundred dollars, a fine of double the amount of the fares of all excess passengers reckoned at the highest rale of fare payable by any passenger on board, and shall in any case be liable to imprisonment for six months" and substituting “guilty of an offence and shall be liable on conviction to imprisonment for 6 months and to a fiue of $10,000 and an additional fine of $5,000 for each passenger in excess of the number allowed by the passenger certificate?".

(1) In subsection (1) by deleting "that person shall in respect of each offence be guilty of a misdemeanor" and substituting "be shall be guilty of an offence and shall be liable on convic- tion to a fine of $50,000 and to imprisonment for 2 years".

(3) In subsection (2) by deleting "liable to a time of four thousand dollars" and substituting "guilty of an offence and shall be liable on conviction to a fine of $50,000 and to imprisonment for 12 months".

(1) In subsection (2)—–—

(a) by deleting "liable to a fine of four thousand dollars" and substituting "guilty of an offence and shall be liable on conviction to a fine of $50,000 and to imprisonment for 2 years"; and

(b) by deleting "liable to a fine of two thousand dollarsTM and substituting "guilty of an offence and shall be liable on conviction to a fine of $20,000 and to imprisonment for 6 months".

(2) In subsection (4) by deleting "liable to a fine of four thousand dollars" and substituting "guilty of an offence and shall be liable on conviction to a fine of $50,000 and to imprisonment for 2 years".

(1) In subsection (1) by deleting "Any master who wilfully misrepresents the number of passengers so about to be carried, or leaves or attempts to leave any port of the Colony without a clearance, shall be liable to a fine of ten thousand dollars and to imprisonment for six months.".

(2) By inserting, after subsection (1), the following new subsection-

"(LA) Any master of a ship who-

(a) in an application under subsection (1) for a port clearance, intentionally misrepresents the number of passengers proposed to be carried; or
