Unlawful use of pleasure veisela.
16. A pleasure vessel which is validly registered in accord- ance with the provisions of Part VII of the Merchant Shipping (Launches and Ferry Vessels) Regulations shall be deemed to be licensed under regulation 3 of these regulations.
17. Any person who uses a pleasure vessel without the con- sent of the owner of the vessel shall, without prejudice to the provisions of any other law, be guilty of an offence and shall be liable on conviction to a fine of one guamant dollars.

Explanatory Note.
(This Mote is not part of the regulations, but is intended to indicare their general purport).
The purpose of these regulations is to provide for the licensing of pleasure vessels and for the issue of local certificates of competency in respect of persons using such vessels.
The term "pleasure vessel" is defined in regulation 2.
Regulation 3 provides for the licensing of pleasure vessels. Regulation 4 provides for the recording of particulars of licensed pleasure vessels and the awttery thereof. Regulation 5 makes it an offence to use an unlicensed pleasure vessel in the waters of Hong Kong
On the transfer of ownership and on the entering into of a charter agreement, the owner of the pleasure vessel is required to notify the Director of the transfer of the charler. In the case of a transfar, the Ticence issued in respect of the vessel shall terminate and the on of renewing the licence shall lie upon the dew owner or charterer (regulation 6).
Regulation 7 provides that every pleasure vessel, while under way in the waters of Hong Kong, shall have on board a person holding a local certificate of competency as master and also a person holding a local certificate of competency as engineer. One person may hold both such certificates or a joint certificate.
Regulation & prescribes the conditions under which the Director may issue local certificates of competency. A person who holds & certificate of competency issued under the Merchant Shipping (Launches and Ferry Vossels) Regulations shall be deemed to have been issued with a local certificate of competency under these regulations.
Under regulation 9, the Director may endorse any local certificate of competency issued by him with such modifications as seen necessary la

him. The holder of a certificate may be requited to produce the certificate on demand by any marine officer of the Marine Department or any police officer.
If the owner of a pleasure vessel ceases to use the vessel as a pleasure vessel he is required to notify the Director, who will cancel the vessel's licence (regulation 10). This is also the case where the picasure vessel ceases to require to be licensed under these regulations, eg, if it is taken out of Hong Kong or if it is destroyed, broken up or wrecked.
Regulation 11 provides for the minimum fire-extinguishing and lifesav- ing equipment that is required to be kept on board every pleasure vessel.
In the event of an accident involving damage of any vessel or injury of any person the Director must be notified of full particulars within forty- eight hours of the accident (regulation 12). A person who fails to so report an accident will be guilty of an offence.
Regulation 13 provides that persons using pleasure vessels shall comply with certain rules specified in the International Regulations for Preventing Collisions at Sea.
Under paragraph (2) of this regulation, any person using a pleasure vessel licensed for use between sunrise and sunset is not required to comply with rules 2 to 14 of the International Collision Regulations. These rules specify, inter alia, the lights that must be exhibited by vessels between sunsel and sunrise.
Regulation 14 provides that the Director may give directions in respect of the anchorags of pleasure vessels.
Under regulation IS the Director may determine the areas in the waters of Hong Kong permitted for the mooring of pleasure vessels. He may also determine the fees for mooring.
The owner of a pleasure vessel that is registered under Part VII of the Merchant Shipping (Launches and Ferry Vessels) Regulations is not required to apply for a licence for his vessel under these regulations (regulation 16).
Regulation 17 provides that any person who uses a pleasure vessel without the consent of the owner of the vessel shall be guilty of an offence.
