shall, within seven days after the ownership of the vessel is trans- ferred or the charter agreement is entered into. notify the Director in writing of the name and address of the new owner or the charterer of the vessel.

(2) A licence shall terminate immediately the ownership of the vessel is transferred and it shall be the duty of the new owner of the vessel to comply with regulation 3.

(3) The owner of a pleasure vessel who contravenes para- graph (1) shall be guilty of an offence and shall be liable on conviction to a fine of two thousand dollars.

7. (1) When any pleasure vessel is under way in the waters of Hong Kong-

(a) the person who is in charge of the vessel shall hold a valid local certificate of competency as master; and

(b) the person who is in charge of the machinery of the vessel shall hold a valid local certificate of competency as engineer.

(2) If the person who is in charge of a pleasure vessel holds valid local certificates of competency both as master and as en- gineer the provisions of paragraph (1) shall be deemed to be complied with.

(3) In the event of a contravention of this regulation. the owner of the pleasure vessel and the person then in charge of the vessel shall each be guilty of an offence and shall each be liable on conviction to a fine of one thousand dollars.

B. (1) Subject to the provisions of this regulation, the Director may issue local certificates of competency, which shall be in such forro as the Director may determine from time to time.

(2) Every application for a local certificate of competency as master or as engineer shall be made on a form specified by the Director and shall be forwarded to the Director together with three identical photographs of the applicant.

(3) The Director may issue a local certificate of competency as master or as engineer if the applicant satisfies the Director of his competency as a master or as an engineer by examination or by such other method as the Director may determine from time to time.

(4) Notwithstanding any other provision of this regulation any person may apply to the Director for a local certificate of

competency as both a master and an engineer in the manner pre- scribed in paragraph (2) and if the applicant satisfies the Director of his competency as both a master and an engineer by examina- tion or such other method as the Director may determine from time to time, the Director may issue to such applicant a combined local certificate of competency as a master and an engineer,

(5) An applicant for a local certificate of competency under this regulation-

(a) shall be not less than eighteen years of age; and

(b) shall not be required to have served on a pleasure vessel

for any specified period.

(6) A person who holds a valid local certificate of com- patency issued to him under the Merchant Shipping (Launches and Ferry Vessels) Regulations shall be deemed to have been issued with a local certificate of competency under this regulation.

9. (1) The Director may cause to be endorsed on any local certificate of competency issued by him under regulation 8 such modifications as he may from time to time consider necessary.

(2) The holder of a local certificate of competency shall, on being so required by any marine officer, assistant marine officer, surveyor of ships or ship inspector of the Marine Department or by any police officer, produce his local certificate of competency to such officer or other person for inspection.

(3) A holder of a local certificate of competency who is unable to produce his certificate for inspection when required to do so under paragraph (2), shall teader it for inspection by an officer of the Marine Department at any Marine Licensing Office within seventy-two hours thereafter.

(4) Any person who contravenes paragraph (3) shall be guilty of an offence and shall be liable on conviction to a fine of one thousand dollars,

10. (1) I

(a) the owner of a licensed pleasure vessel uses the vessel, or permits it to be used, other than as a pleasure vessel; or

(b) a licensed pleasure vessel-

(i) is wrecked or destroyed:

(ii) is removed from Hong Kong; or

(iii) for any other reason, ceases to be used in the waters of Hong Kong.

the owner of the licensed pleasure vessel shall notify the Director in writing within seven days.
