(Chapter 4)

CODE OF CIVIL PROCEDURE (AMENDMENT) RULES 1966.

In exercise of the powers conferred by section 37 of the Supreme Court Ordinance, Wa, the Rules Committee, berely make the following rules-

1. These rules may be cited as the Code of Civil Procedure Citadon and (Amendment) Rules 1966, and shall come into operation on the 1st day commence of February, 1966.

2. Rule 13 of Onder XXIX of the Code of Civil Procedure Amendment (hereinafter referred to as the principal rules) is amended—

(a) by the deletion, in paragraph (1), of “in a summary way, and (Vol. VI,

no petition, case or other formal proceeding, other than such notice of motion, shall be necessary"; and

(8) by the insertion, after paragraph (2), of the following new

paragraph-

"(3) The notice of motion shall be substantially in Form 62 in the Schedule.".

3. Rule 14 of Order XXIX of the principal rules is amended by Amendment the deletion of paragraph (2) and the substitution therefor of the of rule 14 of Order XXIX. following-

"(2) Within the time specified in rule 12 or within such further time as may be allowed by the Registrar the appellant shall leave with the Registrar a copy of the notice of motion to be filed.".

4. Order XXIX of the principal rules is amended by the addition, after rule 14, of the following new rule-

14A. (1) Upon the record of appeal being filed in new rule accordance with rule 15 the Registrar shall set down the appeal and shall fix a date for the hearing of the appeal.

(2) Subject to paragraph (3) the date fixed for the hearing of an appeal shall not be earlier than fourteen days from the expiration of the time allowed by paragraph (4) for giving notice of setting down.

(3) Except with the consent of all the parties to the appeal or by leave of the Full Court or a judge no appeal shall be heard until after the expiration of fourteen days
