(2) If the filter is changed before any treatment, the details of the new filter shall be checked by two persons, one of whom shall be the person administering the treatment, and the other the licensee or a person authorized thereto by the licensee.

(3) Both persons referred to in paragraph (2) after having checked any new filter in accordance with the provisions of that paragraph, shall cause the details of the new filter and the date upon which it was checked to be entered in the treatment record before any treatment is administered.

(4) Any person making any therapeutic application of X-rays who fails to comply with any of the provisions of paragraph (1), (2) or (3) shall be guilty of an offence and be liable on summary conviction to a fine of five thousand dollars.

25. Any person who operates any X-ray machine in an atmosphere which contains ignitable gas or vapour shall be guilty of an offence and be liable on summary conviction to a fine of five thousand dollars.

28. (1) A record shall be kept by the licensee, at the place of Records of application, of every application of X-rays, gamma rays, beta rays or accelerated subatomic particles applied for medical therapeutic purposes, and such record shall be made available for inspection on request by any person authorized by the Board for that purpose.

(2) Any licensee who fails to comply with any of the provisions of paragraph (1) shall be guilty of an offence and be liable on summary conviction to a fine of five thousand dollars.

29. (1) The licensee of any irradiating apparatus shall, if so Waralog required by the Board either generally by notice in the Gazette or botless. individually by notice in writing served upon him by the Board, keep posted in a conspicuous place on or near the irradiating apparatus such notice, in English and Chinese, as the Board may direct drawing atten- tion to the hazards attendant upon the improper use of such apparatus,

(2) Any licensee who fails to comply with any requirement of the Board notified pursuant to the provisions of paragraph (1) shall be guilty of an offence and be liable on summary conviction to a fine of two thousand dollars.

PART VI

OPERATION OF IRRADIATING APPARATUS.

26. (1) No person other than a medical practitioner or a person acting under his personal supervision shall operate an irradiating up- paratus for any purpose affecting the human body:

Provided that notwithstanding the provisions of this regulation, a dental practitioner or a person acting under his personal supervision may operate a dental X-ray machine for the diagnosis of conditions of the teeth or jaws,

(2) Any person who contravenes any of the provisions of para graph (1) shall be guilty of an offence and be liable on summary conviction to a fine of five thousand dollars.

27. (1) Any person who has in his possession any irradiating of irradiating apparatus shall within three months after the commencement of these regulations declare to the Board, by completion of such form of declara. tion as the Board shall require, full particulars of such apparatus and the safety measures employed to guard against radiation hazards.

(2) Declaration forms for completion in accordance with part- graph (1) shall be obtainable from the Medical and Health Departmeot free of charge on application.

(3) Any person who fails to comply with any of the provisions of paragraph (1) shall be guilty of an offence and be liable on summary conviction to a fine of two thousand dollars.

PART VII.

TRANSITIONAL PROVISIONS.

30. (1) Nothing contained in paragraph (1) of regulation & shall Transitional be construed to affect the employment of any person employed in radia. provisions, tion work at the date of the commencement of these regulations.

(2) For the purposes of paragraph (1) of regulation 9, where any person is employed in radiation work at the date of the commence- meat of these regulations the period of fourteen months referred to in that paragraph shall be deemed to run with effect from such date.

(3) No person shall be convicted of any offence created by any of the provisions of regulation 16, 17, 18, 19 or 20 which occurs within a period of three months after the date of the commencement of these regulations.
