of innoculation against the enteric group of fevers or, as the case may be, of immunization against such other disease as may be so specified, or a certified copy thereof, showing that any person employed, engaged or taking part in such business, has been so vaccinated, inoculated or immunized shall be prima facie evidence in any court of the commis- sion by him of a contravention of the provisions of paragraph (1).".

By-law 35 of the principal by-laws is amended in paragraph (1) of by-law 15. by the insertion, after the words "paragraph (1) of by-law 23,", of the

following-

"paragraph (1) of by-law 23A.".

(This Note is not part of the by-laws, but is intended to indicate their general purport).

The effect of these by-laws is-

(a) in respect of by-law 23-which makes it an offence for any persons to engage in any food business who has not been vaccinated against small- pox or inoculated against the enteric group of fevers, or immunized against any other specified disease (cholera is at present specified)—w shift the burden of proof that he had been so vaccinated, inoculated or immunized onto the person su engaged; and

(b) to prevent proprietors of food businesses employing persons therein who

have not been so vaccinated, inoculated or immunized.

Resolution made and passed by the Legislative Council under section 144 of the Public Health and Urban Services Ordinance, 1960, on the 14th day of October, 1964.

RESOLVED, pursuant to section 144 of the Public Health and Urban Services Ordinance, 1950, that the Food Business (Amendment) (No. 2) By-laws, 1964, made by the Urban Council on the 1st day of September. 1964, under section 56 of that Ordinance be approved.
