HONG KONG AIR NAVIGATION (AIRPORT FEES) REGULATIONS, 1964.

In exercise of the powers conferred by Article 77 of the Colonial Air Navigation Order, 1961, the Governor has made the following regulations-

1. These regulations may be cited as the Hong Kong Air Naviga- Citation. tion (Airport Fees) Regulations, 1964.

2. The Hong Kong Air Navigation (Airport Fees) Regulations, Revocation. 1960, are revoked.

Explanatory Note.

(This Note is not part of the regulations, but is intended to indicate their general purport).

It is considered that the Hong Kong Air Navigation (Airport Fees) Regulations, 1960, are invalid because the Colonial Air Navigation Order, 1955, under which they purport to be made, confers no power to make regulations pres- cribing charges for the use of Government airports. The Colonial Air Navigation Order, 1955, has been replaced by the Colonial Air Navigation Order, 1961, but, likewise, that Order confers no power to make regulations prescribing charges for the use of Government airports.

2. It is intended that, for the future, charges for the use of Hong Kong Airport will be recovered on a contractual basis.

3 In order to remove any possible doubt, these regulations formally revoke the Hong Kong Air Navigation (Airport Fees) Regulations, 1960.
