Repeal and replacement of section 11.

8. Section 11 of the principal Ordinance is repealed and replaced by the following—
"Member- ship, etc.

11. (1) Save as is provided in subsection (2), any person who is or acts as a member of an unlawful society or attends a meeting of an unlawful society or who pays money or gives any aid to or for the purposes of an un- lawful society shall be guilty of an offence and shall be liable on conviction on indicument-
(a) in the case of a first conviction for that offence to a fine of one thousand dollars and to imprison- ment for twelve months; and
(b) in the case of a second or subsequent conviction for that offence to a fine of five thousand dollars and to imprisonmical for five years.
(2) Any person who is or acts as a member of a Triad Society or attends a meeting of a Triad Society or is found in possession of or has the custody or control of any books, accounts, writing, lists of members, scals. banners or insignia of or relating to any Triad Society or to any branch of a Triad Society whether or not such society or branch is established in the Colony, shall be guilty of an offence and shall be liable on conviction on indictment-
(a) in the case of a first conviction for that offence to a fine of two thousand dollars and to imprison- ment for three years; and
(b) in the case of a second or subsequent conviction for that offence to a fine of five thousand dollars and to imprisonment for seven years.”.
Section 12 of the principal Ordinance is amended by the of section 12. deletion of the words “on summary conviction to a fine of one thousand dollars and to imprisonment for one year" and the substitution therefor of the following—

"on conviction on indictment in the case of a first conviction for thai offence, to a fine of five thousand dollars and to imprisonment for three years and in the case of a second or subsequent conviction for that offence, to a fine of ten thousand dollars and to imprison- ment for five years”.
10. Sections 12A, 12B and 12C are amended by the deletion of the words "summary conviction" wherever the same occur and the substitution therefor of the following-
"conviction on indictment”.

11. Section 12C of the principal Ordinance is amended by the Amendment deletion therefrom of the words and figures "or subsection (2) of of section section 15".

12. Section 120 of the principal Ordinance is repealed and re- Amendment placed by the following-

If the registration or exemption from registra- tion of any society has been cancelled under section 5E. any office-bearer of such society at the time of such cancel- lation who, after that time, becomes an office-bearer of any other society without the permission in writing of the Registrer shall be liable on conviction on indictment to a fine of three thousand dollars and to imprisonment for three years.".

13. Section 15 of the principal Ordinance is repealed and replaced Repeal and by the following--

15. (1) No society shall carry on any activities until the society has been registered or exempted from registra- tion under this Ordinance save only such activities as are necessary to enable the society to complete the formation of the society and to apply to the Registrar for such registra- tion or exemplion from registration.
(2) Any member of a society which contravencs the provisions of this section shall be guilty of an offence and on conviction on indictment shall be liable to a fine of one thousand dollars and to imprisonment for six months.”.
14. Section 16 of the principal Ordinance is amended by the Amendment deletion in subsection (3) of the word "thenceforward" and the sub- of section 16. stitution therefor of the following-
"from such date and time as shall be stipulated in the order".
15, Section 21 of the principal Ordinance is amended by the Amendment deletion of the word, figures and symbols "130, 12D and 15" and the of section 21. substitution therefor of the following-
"10, 11, 120 and 12D".
16. The principal Ordinance is amended by the addition after Addition of section 23 of the following new section-
"Protection
23A. Without prejudice to the provisions of section of informers. 20, except as is hereinafter provided—
(a) no information laid under this Ordinance shall be admitted în evidence in any civil or criminal proceedings whatsoever;
