2. Subsection (1) of section of the principal Ordinance is of section 2 amended by the deletion of the semi-colon at the end of paragraph (a) of the definition "pensionable emoluments" and the addition thereto of the following-

"and provided further that, except in computing the pension, allowance or gratuity payable in respect of the service of an officer who continued to be in receipt of cost of living allowance up to the date of his retirement or death, ninety per cent only of sub- stantive salary in respect of service after the 30th day of June, 1959, shall be included in the expression "pensionable emoluments";",

3. The principal Ordinance is amended by the deletion in sections of sections 7. 7 and 11 and subsection (1) of section 17, the proviso to subsection (I) of section 17A and subsection (5) of section 19 of the words "in Council" wherever they occur,

4. The principal Ordinance is amended by the addition after section 13 of the following new section-

(a)

134. It shall be a condition of the grant of every pension or other allowance that the Governor in Council may cancel or reduce it if it be shown to have been obtained by the wilful suppression of material facts or to have been granted in ignorance of facts which, had they been known before the retirement of the officer, would have justified his dismissal or a reduction of bis salary.".

Section 17 of the principal Ordinance is amended-

by the deletion in paragraph (1) of subsection (1) of the words "one thousand one hundred and fifty-two dollars" and the substitution therefor of the following-

"one thousand three hundred and forty-four dollars on in the case of an officer who was not at any time is receipt of salary and allowances on a scale provided by the implementation of the Salaries Commission Report 1959, or otherwise provided subsequent to the 30th day of June, 1959, one thousand one hundred and fifty-two dollars"; and

(b) by the deletion of subsection (6) and the substitution therefor

of the following-

"(6) This section shall not apply in the case of the death of any officer if his dependants, as defined in section 3 of the Workmen's Compensation Ordin- ance. 1953, are entitled to and have received com' pensation under the provisions of that Ordinance is respect of such death.".
