Schedule.

"charitable purpose" means any of the following purposes-

(a) the relief of poverty;

(b) the advancement of art, education, learning, literature,

science or research;

(c) the making of provision for the cure or mitigation or prevention of, or for the care of persons suffering from or subject to, any disease or infirmity or disability affecting human beings (including the care of women before, during and after child-birth);

(d) the advancement of religion;

(e) any ecclesiastical purpose;

(f) the promotion of the moral, social and physical well-

being of the community;

(g) any other purpose beneficial to the community o

falling under any of the preceding paragraphs;

"charity" means-

(a) any body of persons, whether corporate or unincor- porate, established primarily for any charitable purpose; and

(b) any body corporate incorporated by any Ordinance

specified in the First Schedule; and

3. (1) Save as in this Ordinance expressly provided and Prohibition

against notwithstanding the provisions of any other enactment, land acquisition shall not be assured to or for the benefit of or acquired or of land by possessed by or on behalf of or for the benefit of any charity or except by

licence assured, acquired or possessed for any charitable purpose, other- of the wise than under the authority of a licence granted by the Governor, and if any land is so assured, acquired or possessed otherwise than as aforesaid, such land shall be liable to forfeiture to the Crown from the date of such assurance, "acquisition or possession, and the Crown may enter on and hold the land accordingly.

(2) For the purposes of this section, the Crown's right of re-entry shall be enforceable under and in accordance with the provisions of the Crown Rights (Re-entry) Ordinance and the (Cap. 128). provisions of that Ordinance shall apply as if such right of re- entry had arisen by reason of the breach of a covenant in a Crown lease:

Provided that where an applicant for relief applies to the Court under section 3 of that Ordinance, no relief shall be granted by the Court except where the applicant satisfies the Court that the land in question was not assured, acquired or possessed in contravention of any of the provisions of this Ordinance.
