44. (1) Before any person becomes an occupant of a building. in a cottage resettlement area he shall be given, by the competent authority or by an authorized officer, a completed occupation permit.

(2) If a person accepts an occupation permit from the coms petent authority or an authorized officer and enters into occupation of the premises to which the occupation permit relates, he shall become from the time when he enters into occupation of the premises, a permittee thereof subject to the terms and conditions set forth in the occupation permit and to the provisions of this Ordinance and of any regulations made under section 51.

(3) A competent authority, in his absolute discretion, may make an occupation permit subject to any special conditions not being inconsistent with the provisions of such regulations;

Provided that-

(i) no special condition shall impose a fee greater than the fee which might be charged in accordance with the pro- visions of such regulations; and

(ii) a copy of all such special conditions, in English and in Chinese, shall be inserted in or attached to the occupation. permit to form part of the occupation permit and shall be handed to the permittes at the time of imposition of the special conditions,

45. (1) A competent authority may revoke any occupation tion permit. permit issued in accordance with the provisions of section 43 for breach of condition, whether general or special, or in accordance with such conditions.

(1) On any such revocation the permitter and the depend- ants, as from the date on which the revocation takes effect, shall be deemed to be trespassers and shall be liable to eviction in manner provided in section 50.

(3) On the issue of a notice revoking the occupation permit, the permittee may remove and dispose of any of the materials of which the building is comprised, subject to the rights of any person thereto.

(4) No court shall entertain any proceedings claiming relief in relation to the revocation of an occupation permit under sub- section (1).

(5) On the date on which the revocation takes place, the building and all the materials of which it was comprised shall be deemed to be the property of the Crown free from the rights of the permitter but subject to the rights of any other person;

Provided than the competent authority in his absolute dis- cretion and subject to the rights of any other person, may permit a permittee to remove such materials after such date.

(6) Notwithstanding that by reason of the breach of any condition, an occupation permit becomes liable to revocation a competent authority in his discretion may waive such breach and may refrain from revoking such occupation permit upon such conditions as the competent authority shall consider necessary.

(7) If any building in a cottage resettlement area has come into the possession of a rompetent authority by reason of the revocation of an occupation permit, the competent authority may make the occupation of such building by any other person subject to the payment by such other person to the former permittee or to any other person of such sum as the competent authority shall consider just.

(2) There shall be affixed to the occupation permit-

(a) a group photograph of the permittee and of the depend- ants permitted to occupy the building to which the occu- pation permit relates, which photograph shall be signed by a competent authority or authorized officer; and

(b) the official receipt for the last payment of occupation

fee made in respect of the building,

(3) Any permittee who contravenes any of the provisions of this section shall be guilty of an offence and, upon summary conviction, shall be liable to a fine of fifty dollars,
