Letting of buildings.

Commence- ment of tenancy.

(2) Any person who is in occupation of any such building. at the date of coming into operation of this Ordinance under any permit or other document lawfully issued in accordance with the provisions of any enactment relating to the clearance and resettle- ment of squatters shall be deemed to be in occupation thereof as a tenant in accordance with the provisions of this Ordinance, and under a tenancy card issued in accordance with the provisions of section 28, and the exhibition by such person of the permit or other document issued under any such enactment shall constitute the exhibition of a tenancy card in accordance with the provisions of subsection (1) of section 30 so long as such person complies with the provisions of subsection (2) of that section.

27. (1) A competent authority may let, by tenancy card under his hand or under the hand of an authorized officer, for any term or for any period, any building or any part of a building in a reseulement estate, subject to the payment therefor of such rent as may be prescribed by regulations made under section 51.

(2) A tenancy card shall be in such form as shall be pre- scribed by such regulations and shall be in English and in Chinese.

(3) There shall be affixed to each tenancy card a group photograph of the tenant and the dependants and each tenancy card shall contain a list of the dependants.

28. (1) Before any person becomes a tenant of a building in a resettlement estate, he shall be given, by the competent authority or by an authorized officer, a completed tenancy card.

(2) If a person accepts a tenancy card from the competent authority or from an authorized officer and enters into occupation of the premises to which the tenancy card relates, he shall become, from the time when he enters into occupation of the premises, a tenant thereof, subject to the terms and conditions of tenancy set forth on the tenancy card and to the provisions of this Ordinance and of any regulations made under section 51.

(3) A competent authority, in his absolute discretion, may make a tenancy card subject to any special conditions not being inconsistent with the provisions of this Ordinance or of any such regulations:

Provided that-

(i) no special condition shall impose a rent greater than the rent which might be charged in accordance with such regulations; and

(ii) a copy of all such special conditions, in English and in Chinese, shall be inserted in or attached to the tenancy card to form part of the tenancy card or slali be handed to the tenant at the time of imposition of the special conditions.

(4) If any dispute shall arise in respect of any difference between the English version and the Chinese version of a tenancy card, the English version shall prevail.

29. (1) A competent authority may terminate any tenancy Termina created or deemed to have been created in accordance with the tenancy. provisions of section 28 for breach of condition, whether general or special, or may give such notice to quit as may be provided for in the general conditions and thereupon the tenant and the dependants, if any, as from the date from which such revocation takes effect or from the date of expiry of the notice, as the case may be, shall be deemed to be trespassers and shall be liable to eviction in manner provided in section 35.

(2) No court shall entertain any proceedings claiming relief in relation to the termination of a tenancy under subsection (1).

(2) Every tenant shall cause to be affixed to the tenancy card the official receipt for the last payment of rent made in respect of the premises.

(3) A tenant who contravenes any of the provisions of this section shall be guilty of an offence and, on summary conviction, shall be liable to a line of fifty dollars.

31. Any person who without lawful authority or excuse- (a) fails to produce on demand his tenancy card to a com-

petent authority or to an authorized officer; or
