VEHICLE AND ROAD TRAFFIC (Lighting and GUARDING OF ROAD WORKS) REGULATIONS, 1957.

In exercise of the powers conferred by section 3 of the Vehicle and Road Traffic Ordinance, the Governor in Council has made the following regulations-

1. These regulations may be cited as the Vehicle and Road Traffic (Lighting and Guarding of Road Works) Regulations, 1957, and shall come into operation on the 1st day of January, 1958.

2. () In these regulations, unless the context otherwise requires-

"approved lamp" means an electric lamp or a paraffin lamp of design and construction described in the First Schedule or of such other design and construction as shall have been authorized by the Commissioner in accordance with the pro- visions of paragraph (2) and in any case maintained to his satisfaction:

"approved sign" means a sign of design and construction de- scribed in the Second Schedule or of such other design and construction as shall have been authorized by the Commis- sioner in accordance with the provisions of paragraph (2) and in any case maintained to his satisfaction ;

"approved traffic signals" means traffic signals to regulate the flow of traffic in alternate directions, of design and construc- tion described in the Third Schedule or of such other design and construction as shall have been authorized by the Com- missioner in accordance with the provisions of paragraph (2) and in any case maintained to his satisfaction;

"Commissioner" means the Commissioner of Police and any

person authorized in writing by him;

"day" means any time other than during the hours of darkness;

"excavation" means any opening or excavation made in any road;

**hours of darkness' means the period between half an hour after sunset and half an hour before sunrise and any period of fog or abnormal darkness;

"obstruction" means any materials, rubbish, tools or other thing placed upon any road in such a manner as to obstruct or endanger the passage of any person or of any vehicle on the road;

"person responsible" means the person by whose order or under whose direction an obstruction or excavation is made or main- tained.

(2) On the application of any person, the Commissioner may authorize the use of a lamp or of a sign or of a traffic signal as an approved lamp or as an approved sign or as an approved traffic signal notwithstanding that such lamp or such sign or such traffic signal is not of design and construction described in the First Schedule, in the Second Schedule or in the Third Schedule, as the case may be, if the Commissioner is of the opinion that the lamp, sign or traffic signal is of such design and construction as make it suitable for that purpose.

3. (1) When any obstruction is placed upon any road or Marking any excavation is made in any road the person responsible shall-

(a) keep such obstruction and such excavation marked by ticos and

day by one or more appropriate approved signs; and (b) keep such obstruction or excavation continuously lighted during the hours of darkness by one or more approved lamps showing a red light,

placed in such a manner and in such positions as to indicate sufficiently to pedestrians, and to drivers of vehicles, approaching from any direction the position and full extent of the obstruction or excavation.

(2) If any obstruction or excavation exceeds four feet in width measured at right angles to any line of traffic or to twelve feet in length measured parallel thereto, the person responsible shall keep such obstruction or excavation continually lighted during the
