Repeal and

Section 48 of the principal Ordinance is repealed and

"Licensing Board for

48. (1) There shall be a board of licensing urban area. justices (in this section referred to as the Board) for all parts of the Colony other than the New Territories but including New Kowloon,

(2) The Board shall consist of the Secretary for Chinese Affairs who shall be chairman, the Solicitor General who shall be vice-chairman, and five other members who shall hold office for three years. A secretary to the Board shall be appointed by the Governor.

(3) Two of the members of the Board shall be unofficial justices of the peace appointed by the Governor.

(4) Three of the members of the Board shall be elected by the unofficial justices of the peace from among their number:

Provided that if no nomination is received, or if nominations are not received for all the vacancies announced, the Governor may appoint a justice or justices to fill the vacancy or vacancies.

(3) If any licensing justice who was appointed by the Governor under subsection (3) is absent from the Colony, the Governor may appoint another unofficial justice of the peace to act as a member of the Board during the absence of the substantive member.

(6) If any licensing justice who was elected or appointed under subsection (4) is absent from the Colony, the unofficial justices of the peace may elect from among their number a justice to act as a member of the Board during the absence of the substantive member:

Provided that an acting member may be appointed by the Governor if no nomination is received for the acting appointment.

(7) Three members of the Board, one of whom must be the chairman or vice-chairman, shall form a quorum,".

(5) The chairman and one other member of the Board shall form a quoruni.
