Amendment of regula- tion 99 of the principal regulations.

(b) in the case of any other property there shall be paid by way of compensation-

() a sum equal to the amount which might immediately prior to the commandeerment reasonably be expected to be payable by a person for the use of such property during the period of com- mandeerment; and

(1) a sum equal to the cost of making good any damage to the property comman- deered which may have occurred during the period ol commandeerment (except in so far as the damage has been made good during the period by a person acting on behalf of the Governor); and

(iii) a sum equal to the amount of any expenses reasonably incurred for the purposes of compliance with any direction given in pursuance of this regulation :

Provided that if the property commandeered was perishable or has been consumed or lost or can no longer at the time when possession thereof is relin- quished be used for its ordinary purposes or cannot be so used without endangering health or safety, or if the Colonial Secretary so orders, there shall be paid in lieu of compensation under sub-paragraphs (i), (ii) and (iii) hereunder a sum equivalent to the value of the property commandeered immediately before effective possession thereof was taken in pursuance of the powers conferred by this regulation.

(5) For the purpose of this regulation "commandeer" means to require the use of.

(6) This regulation shall have no application to aircraft or to any ship or vessel of a tonnage exceed- ing to tons net or to currency, gold, securities or negotiable instruments".

11. Regulation 99 of the principal regulations is hereby amended by the addition immediately before the full stop at the end of sub-regulation (1) of the words "and may seize any anicle found in the course of such search which he has reasonable ground for believing to be evidence of the commission of an offence against these regulations".
