An Ordinance to authorise and provide for the re-construction of the Register of Trade Marks formerly kept under the Trade Marks Ordinance, 1909, and to adüend and modify the application of the said Ordinance.

Bo it enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof, as follows
1. This Ordinance may be cited as the Trade Marks short cible. Register (Re-ronstruction) Ordinance, 1947, and shall be construed and take effect as one with the Trade Marks Ordinance Ordinance, 1909, hereinafter referred to as the "principal.

2. In this Ordinance-
(a)
The New Register" means any register kept by the Registrar for the purpose of complying with section 4 of the principal Ordinance, not being a register kept by the Registrar prior to the 25th December, 1941.
(b) "The Old Register" means the Register of Trade Marks which, prior to the 25th Decem- ber, 1943, was kept by the Registrar under section 4 of the principal Ordinance,

Any such application shall be supported by such evidence as is necessary to substantiate the claim.
(2) In the event of such application being made in the name of the person who was registered as the proprietor of the trade mark in the Old Register it shall be made in Form No. 1 of the First Schedule to this Ordinance, every other case it shall be made in Form No. 14 of the First
