An Ordinance to provide for the Urban Council to function temporarily without elected members.

BE IT ENACTED by the Governor of Hong Kong with the advice and consent of the Legislative Council thereof as follows:

This Ordinance may be cited as the Urban Council (Transitional Provisiona) Ordinance, 1946.

This Ordinance shall be read and construed as one with the Urban Council Ordinance, 1935, (hereinafter referred to as "the Principal Ordinance").
In sub-section (1) of Section 3 of the Principal Ordinance the words "one year" shall be substituted for the words "three years”.
(1) Notwithstanding any vacancies occurring in the Council by reason of the failure from any cause whatsoever to hold elections of or to elect both or either of the additional members of the Council referred to in sub-section (2) of Section 3 of the Principal Ordinance the Council shall be deemed to be legally constituted without either of such members until any vacancy arising because of any such failure has been lawfully filled.
(2) The preceding sub-section shall cease to have effect after one year from the date of the coming into operation of this Ordinance.
Any additional member who, during the year immediately following the com- ing into operation of this Ordinance, is elected or is appointed by the Governor in default of nomination for election, shall cease to hold office at the expiration of one year from the coming into operation of this Ordinance.
Sub-section (3) of Section 3 of the Principal Ordinance is hereby amended by the substitution of the words “and any enactment amending or substituted for the same" for the words "as amended by the Jury Amendment Ordinance, 1929".
This Ordinance shall come into operation on such date as the Governor shall notify by Proclamation as the commencement of this Ordinance.
