CHAIRMAN (in English):-Council will come to order.

MINUTES

The minutes of the meeting held on 8th November, 1977 were confirmed.

PAPER

The following paper was laid on the table:-

Report to the Urban Council by the Director of Urban Services and Secretary, Urban Council, for the month of November 1977.

MOTIONS

(1) MR. B. A. BERNACCHI, CHAIRMAN OF THE FINANCE SELECT COMMITTEE, moved the following motion (in English):-

"RESOLVED that the Urban Council Financial (Amendment) (No. 2) By-laws 1977 be made under section 37 of the Urban Council Ordinance Cap. 101."

He said:-Mr. Chairman, as the Chairman of the Finance Select Committee, I rise on the motion standing in my name.

These by-laws amend by-law 13 of the principal by-laws with regard to the composition of certain select committees of the Urban Council.

These include the Finance, Museums, Libraries, City Hall & Entertainments and the Recreation Amenities Select Committees which all have power to authorize disbursements in respect of certain expenditure Sub-heads under their control.

Under the present by-law 13, the composition of the select committees concerned when exercising powers under the relevant by-law comprises a chairman or vice-chairman and not less than 4 members. The new by-law 2 provides that the select committees shall consist of not less than 3 members one of whom shall be appointed to serve as chairman. This corresponds to the quorum laid down under standing orders of a minimum of 2 members in addition to the chairman of the Select Committee, and in my view is an adequate quorum and makes the financial by-laws in line with the standing orders.

As some Select Committees contain members who are not members of the Urban Council the new by-law 2 also provides that in the exercise of powers under these Financial By-laws the committees concerned shall consist exclusively of members of this Council as this is Council money that is being authorized.

(2) MR. PETER P. F. CHAN, Chairman of the Markets & Abattoirs Select Committee, moved the following motion (in English):—

“RESOLVED that the Public Market (Amendment) By-laws 1977 be made under section 80 of the Public Health and Urban Services Ordinance Cap. 132.”

He said: Mr. Chairman, I rise on the motion standing on my name:

"THAT the Public Market (Amendment) By-laws 1977 be made under section 80 of the Public Health and Urban Services Ordinance, Cap. 132."

By-law 13 of the Public Market By-laws prohibits any person convicted of any offence against any of the provisions of a particular section (previously section 22 and now section 13) of the Gambling Ordinance, amongst other offences, from carrying on any business, or being employed in or taking part in any business, in any public market for a specified period. The Gambling Ordinance, Cap. 148 has now been repealed and replaced by a new Gambling Ordinance, No. 7 of 1977. Since it is still considered desirable to keep convicted gamblers away from public markets for a period of 2 years (which was deemed by the select committee to be reasonable), it is necessary to amend by-law 13 to show the correct section of the Gambling Ordinance 1977 under which the prohibition is impossible.
