"RESOLVED that the Cremation and Gardens of Remembrance (Amendment) (No. 2) By-laws 1977, Exhumation (Fees) (Amendment) By-laws 1977, Public Cemeteries (Amendment) By-laws 1977, Undertakers of Burials (Amendment) By-laws 1977 and Funeral Parlour (Amendment) By-laws 1977 be made under sections 124E, 118(5), 116, 92B and 123 of the Public Health and Urban Services Ordinance Cap. 132 respectively."
He said: Mr. Chairman, at the Chairman of the Cemeteries, Crematoria and Funeral Parlours Select Committee, I rise on the motion standing in my name:
"That the Cremation and Gardens of Remembrance (Amendment) (No. 2) By-laws, 1977,
the Exhumation (Fees) (Amendment) By-laws, 1977,
the Public Cemeteries (Amendment) By-laws, 1977,
the Undertakers of Burials (Amendment) By-laws, 1977, and
the Funeral Parlour (Amendment) By-laws, 1977,
be made under sections 124E, 118(5), 116, 92B and 123 of the Public Health and Urban Services Ordinance, Cap. 132, respectively."
Fees for disposal of the dead have, in the main, stayed unchanged for many years. The existing cremation fee, for example, was set in 1956, and the burial fee for grave spaces in public cemeteries in 1960. Operational costs, which include staff salaries, maintenance, accommodation and equipment, have increased considerably during this time and have generated a large deficit every year. It is now proposed to revise the present scale of fees as from 1st December 1977, with the object of reducing the deficit incurred by the Council in the provision of such services.
The main purposes of the amendments are to provide for an updating of fees for disposal of the dead, and for the re-naming of the Colonial Cemetery, a name which is no longer appropriate, as the "Hong Kong Cemetery".

(4) MRS. GRACE HO, CHAIRMAN OF THE ENVIRONMENTAL HYGIENE SELECT COMMITTEE, moved the following motion (in English):-
"RESOLVED that the Ventilation of Scheduled Premises By-laws 1977 be made under section 94A of the Public Health and Urban Services Ordinance Cap. 132."
She said:-Mr. Chairman, as the Chairman of the Environmental Hygiene Select Committee, I rise on the motion standing in my name:
"That the Ventilation of Scheduled Premises By-laws 1977 be made under section 94A of the Public Health and Urban Services Ordinance Cap. 132."
The main purpose of these by-laws is to provide better control over ventilating systems in restaurants, theatres, cinemas, funeral parlours and dancing establishments in the urban areas. They incorporate several sections in the Ordinance which will be repealed upon the enactment of these by-laws and also introduce new provisions with which ventilating systems in such premises must comply. The by-laws also subject the licence issued in respect of such premises to revocation for failure to comply with the provisions of certain by-laws.
The new by-laws will come into effect on 28th November, 1977 in conjunction with the date of enactment of the parallel Regulations applicable to the New Territories.
