## MINUTES
The Minutes of the meeting of the Council held on 7th June, 1966 were confirmed.
## PAPERS
THE CHAIRMAN laid upon the table the following paper:-
Report on the work of the Urban Council and Urban Services Department for the month of June 1966.
MR. RAFEEK: Mr. Chairman, as Chairman of the Working Committee of the "Keep Your City Clean" Campaign, I take this opportunity to say a few words concerning the various campaigns which have been organized over the past few months.
As you are aware, Sir, seven campaigns have been carried out in both Hong Kong Island and Kowloon. These campaigns met with enthusiastic response both on the part of members of the public, and on the part of the local districts associations, such as the Kaifongs, Jaycees, Boy Scouts and various hawkers associations and public utility companies. Had it not been for such active response on the part of the public, the results would not have been so successful.
I would also like to pay tribute to the many Government departments for the co-operation given to these seven campaigns. They were the Public Works Department, Resettlement Department, Education Department, Secretariat for Chinese Affairs, Government Information Services, Police, the Housing Authority and the Social Welfare Department. Lastly, I would like to thank the Cleansing Division and Health Education Section of the Urban Services Department for going all out in every single campaign. Our staff have worked closely together with gratifying results. The success achieved in each case has been due in no small measure to their efforts, and I have every reason to believe that this will continue in all future campaigns.

## QUESTIONS
(1) MR. B. A. BERNACCHI asked the following question:-
(a) Is there any legislation as to factory chimneys in Hong Kong?
(b) Further or in the alternative in respect to factories which this Council licenses, do our powers to make by-laws cover regulations as to the construction of chimneys?

THE DEPUTY DIRECTOR OF MEDICAL AND HEALTH SERVICES replied as follows:
The Building (Construction) Regulations 1956, prescribe the construction details of chimneys in general but not specifically of factory chimneys. These Regulations are solely concerned with the safety of the chimney and of the building to which the chimney belongs.

Also, there are no particular provisions relating to factory chimneys in the Factories and Industrial Undertakings Ordinance 1955.
As to the second part of the question, none of the sections in the Public Health and Urban Services Ordinance 1960, enables the Council to make by-laws or regulations governing the construction of chimneys in factories licensed by the Council.
MR. BERNACCHI:- Mr. Chairman, as a supplementary, I would like to ask has legal advice been obtained on the part of the Council as to the second part of the question?
CHAIRMAN:- Not by me, Sir.
MR. BERNACCHI:- In other words, is the Vice-Chairman's answer an answer containing his own personal opinion, or containing legal advice given to him by the Attorney General's Department?
DEPUTY DIRECTOR OF MEDICAL AND HEALTH SERVICES:- Mr. Chairman, I am quite satisfied that the Council has no power to make regulations governing the construction of chimneys. I did not seek any legal advice on this, but I am quite satisfied that my statement is correct.
MR. BERNACCHI:- In view of the question on a food factory that arose at the last meeting, could the Attorney General's department be approached in this matter? Then the question could be referred to the Food and Food Premises Select Committee.
CHAIRMAN:- Sir, in clarification, do you wish me to refer to the Attorney General, the question: "Further or in the alternative in respect to factories which this Council licenses, do our powers to make by-laws cover regulations as to the construction of chimneys?"
MR. BERNACCHI:- Yes Sir.
CHAIRMAN: I will do so, Sir.
MR. CHEONG-LEEN:- Mr. Chairman, can the Vice-Chairman elucidate whether this Council has powers concerning the manner in
