THAT the Wells and Water Storage (Amendment) By-laws, 1963, be made under section 26 of the Public Health and Urban Services Ordinance, 1960.

He said:

Mr. Chairman, the object of this motion is fully given in the Explanatory Note and as it is so clear there is little need for me to enlarge on it.

With these remarks, Mr. Chairman, I beg to move.

MR. K. A. WATSON:-I beg to second the motion.

The question was put.

The motion was carried.

MR. LI FOOK-SHU, Chairman of the Food and Food Premises Select Committee, moved the following motion:

THAT the Food Business (Amendment) By-laws, 1963, be made under section 56 of the Public Health and Urban Services Ordinance, 1960.

He said: I beg to move the motion standing in my name.

The object of this motion is to add two further articles, namely, "leung fan" and "man tau lo", to the list of foods the sale of which is restricted by by-law 30 of the Food Business By-laws, 1960. The sale of these articles has hitherto been restricted under the Prevention of Cholera Regulations, 1938, but it is considered that more effective control can be exercised under the Public Health and Urban Services Ordinance, 1960, and the Food Business By-laws, 1960.

Sir, I beg to move.

DR. R. H. S. LEE:-Mr. Chairman, I beg to second.

MR. A. de O. SALES: -Mr. Chairman, may I speak on this motion? Not being particularly good at begging, Mr. Chairman, I would merely like to register my support.

The question was put.

MR. H. CHEONG-LEEN, Chairman of the Markets Select Committee, moved the following motion:

THAT the Public Market (Amendment) By-laws, 1963, be made under section 80 of the Public Health and Urban Services Ordinance, 1960.

He said: As Chairman of the Markets Select Committee, I rise to move the motion standing in my name. The purpose of these by-laws is to amend by-law 13 of the Public Market By-laws, 1960. At present this by-law gives powers to prevent persons convicted of disorderly conduct, intimidation, extortion and offences against section 18 of the Gambling Ordinance, from carrying on business in public markets. It is now proposed also to include power to prohibit any person convicted of an offence against the Dangerous Drugs Ordinance, from carrying on business or being employed in any public market. The reason for this is that drug addiction is still fairly widespread in Hong Kong and, in fact, there have been several instances recently where persons have been found taking dangerous drugs in markets.

In the present by-law 13, there is no time limit for the service of a notice prohibiting a person convicted of the offences mentioned, from carrying on business in a market, nor is there any indication as to the length of the period of prohibition. It is now proposed to amend the by-law to provide that a notice of prohibition may be served within 90 days after a person's conviction or release from prison, and also that the period of prohibition shall be limited to a maximum period of 2 years from the date of the service of the notice of prohibition.

With these words, I beg to move.

MR. WILFRED S. B. WONG:--Mr. Chairman, I beg to second. MR. A. de O. SALES: -Mr. Chairman, I beg to support this motion.

The question was put.

The motion was carried.
