Flease refer to correspondence ending with Coates' letter to as of 25th January about the Hong Kong Expulsion of undesirables präinance, You will remember that we did not exercise the power of disallowance in respoot of this Ordinance but in our Despatch tio, 64 of 15th March and our Saving No. 322 of 29th March, we rade it clear that:-

(i) the ordinance should only be used in emergency and

NOT "as a convenient method for effecting deportation in cases which should properly be dealt with under the Deportation of Aliens ordinance";

(ii) action should not be taken under the ordinance

without prior consultation with His Imjesty's Government's representative in China.

I now enclose a copy of Hong Kong Saving No. 507 Confidential of 8th way and you will see that the Governor considers that the time has come when action should be taken under the Ordinance. In his view the emergency" is virtually upon us" and application of the Ordinance is essential as a "corollary to the new immigration control measures". requests that the matter should be taken up with His lajesty's charge d'Affaires in Fuking without delay.
