objection in principle to the settlement of this claim privately but if the Soviet Government are unwilling (or unable) to produce the necessary documents to us they are likely to be equally unwilling to produce them to an arbitrator, in which case he would hardly expect to function satisfactorily.

The Ministry of Transport have replied that they have no knowledge of any certificate but see no useful purpose in submitting the matter to arbitration unless the arbitrator were in possession of the documents for which we asked. They added that given the necessary documents they were always ready to reconsider the claim.

I am sending a copy of this letter to Haigh at the Ministry of Transport.
