O METU SEM AL

Sir.

VOLONIAL OFFICE,

The Church House,

14

Smith Street, S.V. 1.

July, 1949.

I have the honour to refer to your Confidential Despatch No, 42 of the 10th Earch and to inform you that the pover of disallowance will not be exercised in respect of Cruinance lo. 5 of 1949 relating to hotel

BOOCKERlation.

2. I would, however, suvest that an early oportunity should be taken to amend Section 7 (m) of the carviänance, The first part of this paragraph zakes it an offence for any person to provide or agree to provide etc., any acomodation or service in relation to a hotel "except for the uses and at the charges sanctioned by or under this Ordinance. .", whereas the Ordinance itself does not prescribe uses and charges and the regulaticos (which forms part of the ruinance) doel only with accommodation and charges reserved for or payable by a particular class namely "Hong Kon, residents". I an advised that this means that a hotel manager who provides sooo moviation for a "non-resident" person would be :uilty of an offence, which I appreciate cannot have been your intention.

3.

ith regard to the petition dated 17th February, 1949, from the Hong Song and Koviloon Betels andi Boarding Houses <secodation forwarded with y:ar despatch uniar reference, I should be grateful if you would cause the petitioners to be informed that after the most careful consideration of thair representaticas, supplemented by oral discussion with thir representatives in Landon accompanied by Counsel, I se ne sufficient reason to intervene,

GOV NOR

SIR ALEXAND:01 GĦATT,
