2. The Ordinance enclosed with (1) i.e. "to make better provision for the safety or places declared to be protected" and gives power to authorized guards to shoot it necessary. Its purpose is to check the

R20 % looting and armed robbery which, as we have heard

from several sources (see Sir Waldron smithers letter in 55337) is prevalent in Hong Kong and the SEAC area.

3. I attach file 51239 from 4 on which it will be seen that a similar proposal for strengthening powers for the prevention of trespass into protected places in Singapore was approved. In this case, however, these emergency powers were to be limited to three months. There is nothing on the file to show whether the Governor of Singapore will wish to extend them.

4. The Hong Kong Ordinance does not contain this time limit but as it has been passed and in view of the Governor's assurance to the Legislative Council that "any death resulting from shooting in exercise or alleged exercise of the powers conferred by this Ordinance would be the subject or a magisterial enquiry" I think we can/signify non-disallowance.
