(2) A respondent who has given notice as aforesaid

that he does not intend to oppose the petition shall not

be allowed to appear or act as a party against the petition

in any proceedings thereon.

155. Where a candidate who has been elected is, by a

certificate of the Court, declared not to have been duly

elected, acts done by him in the execution of his office

before the time when the certificate is received by the

clerk of the Council shall not be invalidated by reason of

that declaration.

156. Where on an election petition the election of

any person has been declared void and no other person has

been declared elected in his room, a new election shall be

held to supply the vacancy in the same manner as on a casual

vacancy.

PART XV

TRANSITORY PROVISIONS

First Elections and Nominations of Councillors.

157. (1) The first election of councillors under this

Ordinance shall be held on such date or dates as the Governor

shall notify by Proclamation and the date or dates so notified

shall be deemed for the purposes of the first election to be

the ordinary day or days of election of councillors.

(2) The provisions of this Ordinance with respect to the

election or nomination of councillors shall apply to the first

election or nomination of councillors, mutatis mutandis.

(3) The Governor may appoint a person to be the

returning officer for the purposes of the first election of

councillors and the returning officer so appointed and all

officers appointed to assist him shall have the like powers

and shall discharge the like functions as a returning officer

and such other officers appointed under the provisions of

Part II of this Ordinance.
