holder attaining the age of fifty-five years if and so long

as the period of his tenure of office is, with his consent,

extended by a resolution passed for that purpose by the Council;

but no such resolution shall extend the tenure of office for

more than one year at a time.

(5) If any dispute arises as to whether the clerk of the

Council has become incapable by reason of permanent ill-health

or infirmity of mind or body of discharging with efficiency the

duties of this office, such dispute shall be referred to the

Governor, and the decision of the Governor shall be final.

55. (1) The Council shall appoint a fit person to be

municipal treasurer and may pay to the person so appointed such

reasonable remuneration as the Council may determine.

(2) The mmicipal treasurer shall hold office during the

pleasure of the Council.

(3) A vacancy in the office of municipal treasurer shall

be filled within four months after its occurrance or as soon as

may be after the expiration of that period.

(4) The offices of clerk of the Council and municipal

treasurer shall not be held by the same person or by persons who

stand stand in relation to one another as partners or as employer and

employee.

56. (1) The Council shall appoint one or more fit persons

to be medical officer or medical officers of health, and may pay

to every person so appointed such reasonable salary as they may

determine,

(2) A person shall not be appointed a medical officer of

health unless he is a duly qualified medical practitioner and is

the holder of a diploma in sanitary science, public health, or

state medicine or in lieu of holding such diploma possesses

qualifications of which the Governor approves.

(3) A medical officer of health shall not be appointed

for a limited period only but shall hold office during the

pleasure of the Council, so, however, that he shall not be

dismissed from his office without the consent of the Governor.
