I would suggest that the imposition of such a condition on foreign companies since it also applies to our own local companies, may be considered to be within the provisions of Article .. If this premise is not acceptable, I would suggest that the article should be redraftud so as to apply only to restrictions and conditions which are not applicable to the nationals or companies of the High Contracting Party imposing those restrictions and conditions.

Finally, there is one point to which I consider it desirable that reference should be made in the Treaty. While there is reference in article 25 to the observance of certain international conventions and statutes concerned mainly with customs formalities and freedom of transit, there is no mention in the Draft Treaty of the International Convention for the Safety of Life at Sea, 1929, and the international Load Line Convention, 1930. To both of these conventions China is a signatory, and in neither case is the Chinese Government makin; any attempt to discharge the obligations involved in being a signatory. I hould, therefore, very strongly recommend the inclusion of an Article binding both High Contracting Parties to give effect to the provisions of these two Convertiors.
