Custodian's records and account
damage, howsoever caused, sustained by any property taken into the custody or brought under the supervision or control of the Custodian or any person acting on his behalf or to compensate the owner of such property or any other person for any loss or damage sustained, either directly or indirectly, by reason of the taking into custody or under supervision or control or by the management, disposal or sale of any such property or the collection or disposal of the income thereon or the disposal of the proceeds of the disposal or sale thereof.
13. There shall be paid to the Custodian in respect of his functions under this Proclamation a fee at the rate of One per cent. on all sums received by the Custodian and on the capital value of all property which he shall take into his custody or bring under his supervision and control.
The Chief Civil Affairs Officer may from time to time by order vary the amount of the above fee and prescribe conditions as to the time and manner of collection and disposal thereof.
14. All fees payable to the Custodian and all expenses incurred by him in connection with taking into his custody or bringing under his effective supervision and control any property and all expenses in connection with the maintenance or management of any such property or with the sale or disposal thereof or the distribution or disposal of the income therefrom or the proceeds of sale or disposal thereof shall be a first charge on such property and the income there from or the proceeds of sale or disposal thereof and may be deducted therefrom by the Custodian, subject only in the case of the property of subjects of States allied to His Majesty to any arrangement which may have been made or may hereafter be made by His Majesty's Government.
15. (1) The Custodian shall keep a full and sufficient record in writing of all property taken into his custody or brought under his supervision or control and of all matters, transactions or dealings whatsoever in relation thereto and the income or proceeds of sale or disposal thereof and shall keep full and sufficient accounts in which he shall enter from day to day all his receipts and payments as Custodian, with such particulars as may be necessary clearly to identify the property to which every receipt or payment relates and the said record and accounts and all other documents in the possession of the Custodian shall at all times be open to inspection by the Chief Civil Affairs Officer or any officer authorised by him in that behalf.
(2) The Custodian shall not pay into his private banking account, or use otherwise than for the purpose of performing his functions under this Proclamation, any sums received by him as Custodian.
(3) The Custodian shall open in his name as Custodian an account at a bank approved by the Chief Civil Affairs Officer and shall pay to the credit thereof all sums received by him as such Custodian.
(4) Nothing in this section shall be construed as affecting the powers or duties of the Custodian in relation to any monies received by him in his capacity as Custodian of Enemy Property under the provisions of the Trading with the Enemy Ordinance, 1914.
