A Proclamation concerning the appointment, powers and duties of a Custodian of Property.

WHEREAS it is necessary during the period of military administration to make provision for the custody and control of the property of enemies and enemy subjects and for the preservation, custody and when necessary, the disposal of the property of British subjects and British protected persons and of the subjects of States allied to His Majesty where the owners of such property are not in the Colony and also of property the owners of which are unknown or whose present whereabouts are unknown:

NOW, THEREFORE, IT IS PROCLAIMED as follows:-

This Proclamation may be cited as the Custodian Proclamation, 194

In this Proclamation the following words and expressions shall unless the context otherwise requires, have the meanings hereby assigned to them respectively

-

(1) "Custodian" means the person appointed by the Chief

Civil Affairs Officer under or by virtue of this Proclamation to be Custodian of Property.

(2) "Enemy", subject to the provisions of this section,

(a) any State, or Sovereign of a State, at war with

His Majesty;

(b) any individual resident in enemy territory;

(c)

(a)

any body of persons, whether corporate or unincorporated, carrying on business in any place, if and so long as the body is controlled by a person who, under this section, is an enemy;

any body of persons constituted or incorporated in, or under the laws of, a State at war with His Majesty, inre of full bathan corporate or unincorporaty) carrying on that trasiness;

of any in siness carried on in enting ruritory, any individual, or but does not include any person by reason only that he is an enemy subject.

(3) "Enemy Subject" means

(a) an individual who, not being either a British

subject or a British protected person, possesses the nationality of a State at war with His Majesty, or

(b)

a body of persons constituted or incorporated in, or under the laws of any such State.

(4) "Person" or "subject", except so far as relates to the

imposition of the penalty of imprisonment, includes a body corporate, or a firm, institution, club or any other body or association of persons, whether corporate or unincorporated, capable of owning property or any interest therein.

(5) "Property" includes all forms of movable or immovable

property and all rights, title or interest to or in any such property.
