Persons eligible to be members of the Courts.

-Constitution

of the Higner Court.

(2) Every sentence by a District Court of imprisonment

exceeding three years (whether sucn sentences shall be a sentence of imprisonment only or a sentence of imprisonment in aefault of payment of a line or a combination of such sentences) or of a fine exceeding two thousand dollars or or 1logging exceeding twelve strokes shall be subject to confirmation by the Chief Civil Allairs Officer.

9. Every Stafi Ollicer (Legal) and every British Officer nominated for that purpose by the Cuier Civil Aflairs Oficer or Deputy Chief Civil Affairs 011icer snall be eligible to act as a member of any Court established by tuis Proclamation.

10. (1) The President of the Higner Court shall be such

Staff Officer (Legal) as the Chief Civil Allairs Officer snall from time to time designate as such.

(2) A court of the Higner Court snall consist of the following members, namely

Constitution of 11. Urban District. Courts.

Constitution of 12.

New Territories District Courts

Sittings of 13. the Courts.

(a) for the trial of any ollence

the President of ine Higner Court or any other Staff Oflicer (Legal) not below the rank of captain, sitting with two British Officers, whether Star Oriicers (Legal) or otherwise.

or such

(b) for any other business in sucn Court - tue President of the Higher Court, otner Staff Officer (Legal) as he shall from time to time designate for the purpose sitting alone.

(3) The President of the Higher Court shall preside in any court of whicn ne is a member and shall decide who shall preside in any Higner Court of which he is not a member.

Each Court of the Urban District Courts shall consist of a Staff Officer (Legal) sitting alone, anu such Officer shall be appointed by the Cniel Civil Allairs Officer or Deputy Chief Civil Affairs Officer: Dut if the exigencies of the service so require any such Urban District Court may consist of such one or more British Officers other than Stall Ollicers (Legal) as the Culeï Civil Allairs Üllicer or Deputy Chief Civil Allalrs Ollicer may appoint for that purpose.

Each New Territories District Court shall consist of such Civil Affairs Qilicer of ouer British Officer as the Chief Civil Affairs Officer or Deputy Chief Civil Affairs Officer may appoint for that purpose.

(1) The Courts suali nold their sittings at such

places as the Chiei Civil Affairs Officer, or any Other Officer authorisea by him in that benalf, may by Proclamation apoint.
