(1) The Port Trust may, in the manner hereinafter set forth, seize

and detain any vessel within the limits of the territorial waters

of Hong Kong in the following cases:

(a) whenever any sum is due in respect of the vessel for ratu.

dues or tolls or for commuted rates, dues or tolls and is

unpaid;

(b) whenever the master, owner or person in charge of the vessel

has violated or has failed to observe any provision of this

Ordinance, or any by-law in force under this Ordinance, and

has rendered himself liable to any penalty;

(c) whenever any injury has been done by the vessel or by the

fault or neglect of the crew, while acting as the crew or

under order of their superior officers, to any works or

property under the administration, management and control

of the Port Trust;

(d) whenever any obstruction whatever has been offered or maĉ :

to the operations of the Port Trust by any vessel or by

the fault or neglect of the crew, while acting as the cre

or under order of their superior officers.

(2) In a case coming within paragraphs (c) and (d) of sub-section

one of this section, the vessel may be seized and detained until

the injury so done has been repaired and until all damages thereby

directly or indirectly caused to the Port Trust (including the

expense of following, searching for, discovery and seizing of such

vessel) have been paid to or security for such payment accepted by

the Port Trust; and for the amount of all such injury, damages,

expenses and costs, the Port Trust shall have a preferential lien

upon the vessel and upon the proceeds thereof until payment has been

made or adequate security has been given for such damages, whether

direct or indirect, and for the amount of all such injury, damages,

expenses and costs as may be awarded in any suit resulting therefr

and the owner, charterer, master or agent of such vessel shall als

be liable to the Port Trust for all such injury, damages, expenses

and costs.

(3) The Port Trust shall have a lien upon any vessel and upon the

proceeds thereof in preference to all other claims and demands what-

soever (saving and excepting the claims for wages of seamen, under
