Government has not been wholly free from blame itself in this matter, and to proceed against Mr. Forrest under the procedure laid down in Colonial Regulations might well lead to charges that he was being made a scapegoat for the shortcomings of his superiors as much as being arraigned for his own fadlings.

As regards the Governor's further request in paragraph 8 of the telegram, as Mr. Forrest is threatening suicide I should have thought it was unwise to let him have a copy of the Report before he leaves the Colony. We don't want his death on our hands, but when he has had a chance to get out of the atmosphere of Hong Kong and somewhere where the troubles of his Department will mean wawadately west to nothing and he won't see the "finger of scorn" pointed at him, he may be able to recover his mental stability. The publication of the Report should, I think, be withheld until the Secretary of State has had an opportunity of perusing it. It is not merely a local matter, since the word of H.M.G. is also at stake. The Chinese Government protested strongly against the introduction of the legislation in question, and while we maintained the necessity for bringing it into force, we assured them both through the Chinese Ambassador hereʼand through H.H. Ambassador in China; that the legislation would be administered efficiently and sympathetically. We don't want to provide the Chinese Government with ammunition for attacking us on this score, and it is to be hoped that the reorganisation of the Department will mean that it will work more in accordance with the spirit of undertakings which have been given to the Chinese Government.

In replying to the telegram on the lines suggested above, I think we should also add that the Secretary of State has been somewhat exercised at learning of the state of affairs disclosed, and that in view of the definite undertakings which have been given to the Chinese Government, he trusts that all possible steps have been taken to see that the Immigration Legislation is now being, and will be in future, administered tactfully and sympathetically.
