I am a little bit prejudiced because

I always had difficulty in seeing how the evacuation of a certain number of European women from Hong Kong could be said to be necessary for defence, but the matter has been decided and is summed up in the minutes under 231 on 13139/11/40 and the telegram 231A on that paper. Mrs. Black comes within the second category, namely a person who had left the Colony. There is therefore a clear distinction between her case and those people to whom the Governor refers.

I had assumed that the Governor was in a position to deal with her under the Defence (Entry Restrictions) Regulations for which there is a precedent in the case of Mrs. Blair, and which have been held to be valid by the court in Hong Kong. I hope it is not correct, as Mr. Monson thinks, that the Governor will have to use the Regulation of June, 1940, because I should feel some doubts as to its validity. If, however, as I thought Mrs. Black comes within the same category as Mrs. Blair, I do not know why one should be deported and not the other, especially as Mrs. Black's is a deliberate case of refusing to abide by an undertaking which the other case was not.
